These Terms of Use ("Terms") govern your access to and use of J SITE™, a mobile application operated by Lily Technologies™ LLC ("Lily Technologies," "we," "us," or "our"), a limited liability company registered in the State of Maine, USA. By creating an account or using J SITE™ you agree to be bound by these Terms.

1. Eligibility

J SITE™ is intended for use by adults (18 years of age or older) in professional trade and construction environments. By using J SITE™ you represent that you are at least 18 years of age and have the authority to enter into these Terms on behalf of yourself or your organization.

2. Account Registration

To use J SITE™ you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Account holders are responsible for the accounts they create for employees and team members under their company account.

3. Subscription and Billing

J SITE™ is offered on a subscription basis. A 14-day free trial is provided upon account creation. No credit card is required to begin the free trial. After the trial period, continued use requires a paid subscription.

• Subscriptions are billed per seat (account holder plus each additional user).
• Only the account holder has the ability to start, stop, pause, resume, or cancel a subscription, and to manage billing information for any member of the team.
• Current pricing is available within the app. Pricing is subject to change with reasonable notice.
• Subscriptions automatically renew at the end of each billing period unless cancelled.
• Refunds are not provided for partial billing periods.
• Failure to maintain an active subscription may result in restricted access to the app.

4. Material Ordering

J SITE™ provides tools to submit material orders to third-party suppliers. Lily Technologies acts as a technology intermediary only. We are not a party to any transaction between you and a supplier. All order fulfillment, pricing, invoicing, delivery, and disputes are solely between you and the supplier. Lily Technologies assumes no liability for supplier errors, fulfillment failures, pricing discrepancies, or order disputes.

For API-integrated supplier orders, a transaction fee calculated as a percentage of the confirmed order total may be applied. Fee schedules are disclosed within the app and are subject to change with notice.

4a. Third-Party Mapping Services

J SITE™ uses Mapbox to provide map rendering, terrain visualization, and location-based features within the app. When you use map features, Mapbox may collect your device's IP address, approximate location, and usage data in accordance with their privacy policy available at mapbox.com/legal/privacy.

Map terrain and elevation data is sourced from publicly available datasets including the U.S. Geological Survey (USGS) 3D Elevation Program. Elevation readings are provided for informational purposes only and should not be relied upon for engineering, surveying, or safety-critical decisions.

By using the map features within J SITE™ you acknowledge and agree to Mapbox's Terms of Service.

5. Safety Feature

The safety reporting and GPS proximity alert features within J SITE™ are informational tools only and are provided for the purpose of general awareness and communication among team members.

• These features are NOT a substitute for proper safety training, personal protective equipment, site safety plans, or compliance with OSHA regulations or any other applicable safety laws.
• GPS-based proximity alerts are NOT guaranteed to be accurate. Accuracy may be significantly reduced indoors, in densely built areas, or due to device hardware limitations.
• Hazard zone boundaries displayed in the app are approximate estimates only and should not be relied upon as definitive safety perimeters.
• Lily Technologies™ LLC expressly disclaims all liability for any injury, death, property damage, or loss of any kind arising from or related to reliance on the safety reporting feature, GPS proximity alerts, or any information displayed within the safety section of J SITE™.
• By using the safety feature you acknowledge that you have read and understood this disclaimer.

6. User Content

You retain ownership of content you submit to J SITE™ including photos, notes, reports, messages, and other data. By submitting content you grant Lily Technologies a limited license to store and process that content solely for the purpose of providing the J SITE™ service to you.

You are solely responsible for the content you submit. You agree not to submit content that is unlawful, harmful, or violates the rights of others.

6a. In-App Messaging and User Conduct

J SITE™ includes an in-app messaging and chat feature that allows users within a company to communicate with one another. All users must agree to the following conduct standards when using the messaging feature:

• Do not send or share content that is threatening, harassing, abusive, defamatory, obscene, or otherwise objectionable.
• Do not use the messaging feature to bully, intimidate, or discriminate against any individual on the basis of race, gender, religion, nationality, sexual orientation, disability, or any other protected characteristic.
• Do not share illegal content, personal information of others without their consent, or content that infringes on any third-party intellectual property rights.
• Do not use the messaging feature for spam, solicitation, or any commercial purpose unrelated to your work within J SITE™.

Lily Technologies™ LLC reserves the right to review reported messages and take action — including suspension or termination of accounts — for violations of these conduct standards.

6b. Reporting Objectionable Content

If you encounter a message that violates these Terms, you may report it directly within the app by long-pressing the message and selecting "Report Message." You will be asked to select a reason for the report (Harassment, Threats, Inappropriate Content, Spam, or Other).

When a report is submitted:

• The report is logged in our system and reviewed by Lily Technologies.
• The company owner and/or admin of the account is also notified of the report.
• We will investigate the report and take appropriate action, which may include a warning, content removal, account suspension, or termination.
• We do not guarantee a specific response time, but we take all reports seriously.

Submitting a false or malicious report is a violation of these Terms and may result in action against your account.

6c. Blocking Users

You may block another user within J SITE™ from the in-app messaging feature. Blocking a user prevents you from seeing their messages. Blocked users are not notified that they have been blocked. You may unblock a user at any time from the Blocked Users section of your account settings.

Blocking a user does not constitute a formal report. If you believe a user has violated these Terms, please also submit a report as described in Section 6b.

7. Employer and Employee Accounts

Account owners who create employee accounts within J SITE™ are responsible for ensuring that their use of the app complies with applicable employment laws, including laws related to time tracking, wage and hour requirements, and employee privacy. Lily Technologies is not responsible for how account holders use employee data collected through the app.

7a. GPS and Location Services

J SITE™ may request access to your device's location for the following purposes:

• Time Tracking (Optional): When GPS time tracking is enabled by the company owner, J SITE™ records your device's GPS coordinates at the moment you clock in, clock out, or begin/end a break. Location is recorded at these discrete events only — J SITE™ does not track your location in the background, continuously, or after your timer has stopped. GPS time tracking may be disabled entirely by the company owner at any time.
• Weather: Your approximate location is used locally on your device to display current weather conditions on the job dashboard. This location data is not transmitted to Lily Technologies or stored on our servers.
• Job Site Map: Your location may be used to center the in-app map view. This is a local device operation only and is not stored or shared.

Location data collected at clock-in and clock-out events is visible to the company owner and admins within your account. Lily Technologies does not sell, share, or use employee location data for any purpose other than providing the J SITE™ service.

Account holders are responsible for complying with all applicable laws regarding employee location monitoring, including obtaining any required consents from employees prior to enabling GPS time tracking.

8. Acceptable Use

You agree not to:

• Use J SITE™ for any unlawful purpose
• Attempt to gain unauthorized access to any part of the app or its infrastructure
• Reverse engineer, decompile, or disassemble the app
• Use the app or its messaging features to harass, threaten, bully, or harm others
• Share offensive, discriminatory, or otherwise objectionable content through in-app chat or any other feature
• Submit false or misleading safety reports
• Submit false or malicious user reports
• Attempt to circumvent a block placed by another user

9. Intellectual Property

J SITE™, its name, logo, design, and all content created by Lily Technologies are the intellectual property of Lily Technologies™ LLC. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written consent.

10. Disclaimer of Warranties

J SITE™ is provided "as is" and "as available" without warranties of any kind, either express or implied. Lily Technologies does not warrant that the app will be uninterrupted, error-free, or free of harmful components. Your use of the app is at your sole risk.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Lily Technologies™ LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of J SITE™, even if advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or your use of J SITE™ shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Lily Technologies™ LLC and its officers, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from your use of J SITE™, your violation of these Terms, or your violation of any third-party rights.

13. Termination & Data Retention

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms. You may cancel your subscription at any time from within the app. Upon cancellation or suspension, your right to access the app ceases immediately, but your company data — including jobs, customers, time logs, photos, and all other records — is retained securely and will remain available if you resubscribe.

To permanently delete your account and all associated data, submit a deletion request through the app (My Account → Delete Account) or by emailing support@jsiteapp.com. Deletion requests are processed within 7 business days. Account holders requesting company-wide deletion should note that this permanently removes all employee profiles, jobs, customers, and data associated with the company account and cannot be undone.

14. Governing Law

These Terms are governed by the laws of the State of Maine, USA. Any disputes arising from these Terms or your use of J SITE™ shall be resolved in the courts of the State of Maine.

15. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted at this URL with a revised effective date. Continued use of J SITE™ after changes are posted constitutes your acceptance of the updated Terms.
